Wireless Telcorp, Inc.’s Acceptable Use Policy

Please read the following Acceptable Use Policy Terms and Conditions established by Wireless Telcorp carefully before signing up or continuing with this Internet Service. By using our Services, you agree to comply with this Acceptable Use Policy, and we may terminate your account if you fail to comply.

PLEASE CANCEL YOUR SERVICE IMMEDIATELY AND NOTIFY US AT aupolicy@wirelesstelcorp.com IF YOU DO NOT AGREE WITH OR ACCEPT THIS POLICY.

Wireless Telcorp, Inc. Internet Service may only be used for lawful purposes. Customers shall not directly or indirectly:

(1) use the Service for transmission, distribution, or storage any information, data or material in violation of any U.S. federal, state or local regulation or law. This includes, but is not limited to, posting or disseminating content which would violate the property rights of others or infringes the intellectual property of any person, including unauthorized copyrighted text, images or programs, trade secrets or other confidential material protected by copyright, trademark, trade secret, or any other statutes.

(2) access any other person’s computer, software, or data of any other person without the knowledge and consent of such person.

(3) post, transmit or disseminate objectionable information that is unlawful, threatening, abusive, libelous, hateful or encourages conduct that would constitute a criminal offense, give rise to a civil liability, or otherwise violate any local, state, national or international law, order or regulation.

(4) post or transmit any information or software, which contains a virus, cancelbot, Trojan horse, worm, (Internet Relay Chat) IRC robots, or other IRC scripts or programs that interfere with or deny service to other users on any server or host. This includes, but is not limited to "flooding" (rapidly entering text with the Internet to fill screen of others), "flashing" (disrupting terminal emulation), "takeovers" (forcibly seizing operator privileges), and other disruptive behaviors.

(5) transmit spam (i.e. mass unsolicited email messages) or flames (the sending of a large number of email messages to a single or multiple addresses); or gain or attempt to gain unauthorized access to systems or accounts owned by Wireless Telcorp or third parties, disrupt service or network connectivity, misuse Wireless Telcorp or third party facilities or create fraudulent accounts.

(6) resell the Service, or otherwise charge others to use the Service for operation as an Internet Service Provider or for any other business enterprise in competition with the Service.

Wireless Telcorp has no obligation to monitor the Service. However, you agree that Wireless Telcorp has the right to monitor the Service electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Service properly, or to protect itself or its subscribers.

Wireless Telcorp reserves the right to refuse to post or to remove any information or materials from its servers, in whole or in part, that in its sole discretion, are unacceptable, undesirable, or in violation of its Acceptable Use Policies. Wireless Telcorp may further deny any person or entity access to all or part of its system, without notice, if such person or entity engages in any conduct or activities that Wireless Telcorp, in its sole discretion, believes violates any of its Acceptable Use Policies.

Wireless Telcorp reserves the right to immediately terminate Service if customer engages in any of the activities listed above or if Customer uses any Wireless Telcorp equipment or services in any way which is contrary to our policy. Users who violate systems or network security may incur criminal or civil liability. Wireless Telcorp will cooperate fully with investigations or violations or systems or network security at other sites, including cooperating with law enforcement authorities in the investigation or suspected criminal violations.

IT IS YOUR RESPONSIBILITY TO VISIT THIS WEB PAGE REGULARLY, AS ALL OR ANY PART OF THIS POLICY MAY CHANGE WITHOUT NOTICE.

Warranties/Disclaimers

Customer assumes total responsibility and risk for their own use of the Internet. Wireless Telcorp’s Internet Service is provided on an "as-is" and "as-available" basis. There will be no assurance that the Service will be uninterrupted or error free, or, that any information or material on the Internet is free of viruses, worms or other harmful components. Therefore the customer understands when accessing the Service, Company will not accept any responsibility for harmful or misguided content in the event of damaging or unlawful acts. The Company makes no other warranties, expressed or implied including but without limitation to any warranties of merchantability or fitness for a particular purpose.

Network Address Ownership

Any IP address(es) assigned to the Customer is considered loaned, not given. The IP address(es) will revert back to Wireless Telcorp after the customer terminates the Service.

Excess Utilization of System or Network Resources

The customer is prohibited from excessive consumption or utilization of system or network resources. The excessive use or abuse of network resources by one customer may have a negative impact on all other customers. Abuse of network resources, which may weaken network performance is strictly prohibited by this policy and will result in termination of the customer’s service.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD WIRELESS TELCORP AND ITS AGENTS OR AFFILIATES HARMLESS FROM ANY AND ALL LIABILITIES, COSTS AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, RELATED TO ANY VIOLATION OF THIS AGREEMENT BY YOUR OR AUTHORIZED USERS OF YOUR ACCOUNT, OR IN CONNECTION WITH THE USE OF THE SERVICE OR THE INTERNET OR THE PLACEMENT OR TRANSMISSION OF ANY MESSAGE, INFORMATION, SOFTWARE OR OTHER MATERIALS ON THE INTERNET BY YOU OR USERS OF YOUR ACCOUNT.
